1. Overview These Terms of Service (“Terms”) govern your access to and use of the website operated by Tankhouse Fragrances LLC (“Tankhouse,” “we,” “us,” or “our”), including all content, features, tools, accounts, and services made available through the website (collectively, the “Services”). By accessing, browsing, or using the Services—including placing an order, creating an account, or submitting reviews or other content—you agree to be bound by these Terms and by our Privacy Policy, Refund Policy, and Shipping Policy, each of which is incorporated by reference and may be updated from time to time. If you do not agree to these Terms, you may not use the Services.
2. Eligibility and Accounts By using the Services, you represent that you are the age of majority in your state or jurisdiction of residence and that you have the legal capacity to enter into a binding agreement. You may create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not transfer, assign, or share your account with another person. We reserve the right to suspend or terminate accounts or access to the Services at our discretion, including in cases of suspected fraud, abuse, chargeback activity, or violation of these Terms.
3. Use of the Services The Services and all content made available through them are provided for personal, non-commercial use. You may not copy, reproduce, scrape, distribute, modify, or commercially exploit any portion of the Services or their content without our prior written consent. Purchase of products for resale is strictly prohibited unless expressly authorized by Tankhouse in a separate written agreement. Unauthorized resale does not grant any right to use Tankhouse branding, imagery, copy, or other intellectual property.
4. Products and Descriptions We make reasonable efforts to display our products accurately; however, product images are for illustrative purposes only, and actual colors, packaging, labeling, availability, and appearance may vary. Products are offered in limited quantities and may be discontinued at any time without notice. Scent preference and fragrance performance—including longevity and projection—are inherently subjective. We do not guarantee satisfaction based on personal olfactory perception. We make no medical, dermatological, or therapeutic claims regarding our products.
5. Orders and Acceptance Placing an order constitutes an offer to purchase. An order is not accepted by Tankhouse until it has been processed and shipped. We reserve the right to cancel or refuse any order prior to shipment for any reason, including suspected fraud, pricing errors, inventory limitations, or violations of these Terms. Once an order has shipped, it cannot be cancelled. Products are intended for sale and use within the United States only. We do not represent that our products comply with regulatory requirements outside the United States, and products may not be exported where prohibited by law.
6. Pricing and Billing Prices, promotions, and availability are subject to change without notice. Taxes and shipping charges are calculated at checkout unless otherwise stated. We reserve the right to correct pricing or description errors, including after an order has been placed, and to cancel affected orders. You represent that all payment information provided is accurate and that you are authorized to use the payment method submitted. Charges will be billed to the payment method provided at the time of purchase.
7. Shipping and Risk of Loss Shipping terms are governed by our Shipping Policy, which is incorporated by reference. Risk of loss and title pass to you upon our transfer of the order to the carrier. Delivery dates are estimates only and are not guaranteed. We are not responsible for delays, loss, or theft once a shipment is marked delivered by the carrier.
8. Returns and Refunds All returns and refunds are governed exclusively by our Refund Policy, which is incorporated by reference. Due to the nature of our products, opened or used fragrances are not eligible for return. Refund eligibility is determined by Tankhouse in accordance with the Refund Policy, and approved refunds are issued only to the original payment method.
9. Product Use and Safety Our products are intended for external use only. Fragrances contain alcohol, are flammable, and must be kept away from heat or flame and out of reach of children. Individual sensitivities vary; we recommend a small patch test before full application. We are not responsible for allergic reactions or adverse effects resulting from product use or misuse. Our products are not intended to diagnose, treat, cure, or prevent any medical condition.
10. Intellectual Property All content on the Services, including trademarks, product names, logos, text, images, photography, audio, video, and design, is owned by or licensed to Tankhouse and is protected by applicable intellectual property laws. You may not use Tankhouse intellectual property without prior written permission. Unauthorized use may result in legal action.
11. Reviews and Feedback If you submit reviews, feedback, or other content, you grant Tankhouse a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such content for business purposes, including marketing and product development. We reserve the right to moderate or remove content that is unlawful, abusive, misleading, or otherwise objectionable. You are solely responsible for the accuracy and legality of content you submit.
12. Prohibited Conduct You may not use the Services to violate any law or regulation, infringe intellectual property rights, engage in fraud or abuse, scrape or harvest data, or interfere with the security or operation of the Services. We may suspend or terminate access for violations of this section.
13. Disclaimer of Warranties The Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
14. Limitation of Liability To the maximum extent permitted by law, Tankhouse shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits or data. Tankhouse’s total liability for any claim arising from a purchase shall not exceed the amount paid for the product giving rise to the claim.
15. Indemnification You agree to indemnify and hold harmless Tankhouse from any claims, damages, losses, or expenses arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.
16. Governing Law and Venue These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. You consent to exclusive jurisdiction and venue in state or federal courts located in New York.
17. Changes to Terms We may update these Terms from time to time by posting revised versions on our website. Continued use of the Services constitutes acceptance of the updated Terms.
